These Terms and Conditions (“Terms”) apply to all purchases made from Makers Market AU (ABN 95898521275, referred to as “we”, “us”, “our”) via our website: https://makersmarket.au

By placing an order, you (“you”, “the customer”, “the buyer”) agree to be bound by the Terms below, and acknowledge that you have read and understood them. These Terms do not limit or exclude your rights under the Australian Consumer Law (ACL).

1. Products Sold

We sell a range of new and used goods. Product listings will clearly indicate if an item is used, including relevant notes on condition. While we make every effort to provide accurate descriptions and images, minor cosmetic wear on used items should be expected.

We recommend that you carefully read item descriptions and request additional information before purchasing if needed.

2. Pricing and Payment

  • All prices listed are in Australian Dollars (AUD) and inclusive of GST unless otherwise stated.
  • We accept payment via the methods shown at checkout. Full payment is required before dispatch.
  • Prices and availability are subject to change without notice.

3. Order Acceptance

Your order is considered accepted once payment is received in full and we confirm dispatch. We reserve the right to cancel or refuse an order at our discretion, particularly in the case of:

  • Incorrect pricing due to system errors;
  • Suspected fraudulent activity;
  • Stock unavailability.

In such cases, a full refund will be issued.

4. Shipping and Delivery

  • We ship orders Australia-wide using reputable carriers.
  • Risk of loss or damage to goods passes to you upon delivery.
  • You are responsible for providing accurate shipping details. Additional charges may apply if redelivery is required due to incorrect address information.

5. Warranties and Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where a product is used or sold “as-is”:

  • You accept that some wear or cosmetic damage may exist.
  • This does not affect your right to a remedy if the item is not fit for purpose or fails to function as described.

For new items, any manufacturer warranties may also apply.

6. Returns and Refunds

In summary:

  • Change of mind returns are accepted within 7 days and are subject to a 10% restocking fee. Return shipping is at your expense.
  • Faulty or misdescribed items are eligible for a full refund or remedy under ACL. In some cases, we may offer to resolve without return.
  • Returns must be requested in writing via email or our contact form.

7. Handling Time

Orders are typically processed and dispatched within 1–2 business days after payment is received.
Please note that this timeframe refers to handling only and does not include shipping or transit times.

Business days are Monday to Friday, excluding public holidays.

8. Shipping Location

All items are shipped from Beechwood, NSW 2446, Australia.

Shipping times may vary depending on your location and chosen delivery method. You will receive tracking information once your order has been dispatched.

9. Limitation of Liability

To the extent permitted by law:

  • We shall not be liable for any indirect, incidental, or consequential loss or damage resulting from the use of our goods.
  • Our total liability shall not exceed the value of the goods purchased.

This clause does not override your rights under the Australian Consumer Law.

10. Intellectual Property

All content on our website, including photos, text, and logos, is the property of Makers Market AU and may not be used or reproduced without written permission.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and any disputes will be resolved under Australian jurisdiction.
